Terms of Service
1. Acceptance of Terms
By creating an account or using the SafeProperty platform, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you may not use the platform. These Terms constitute a legally binding agreement between you and SafeProperty Ltd, a company incorporated in Kenya.
2. Eligibility
You must be at least 18 years old and have legal capacity to enter into contracts under Kenyan law to use this platform. By registering, you represent that you meet these requirements. Corporate users must be duly authorised to act on behalf of their entity.
3. Platform Role
SafeProperty is a technology platform that connects property owners, landlords, agents, buyers, and renters. We are not a party to any rental or sale agreements concluded through the platform. We do not own, manage, or inspect properties listed on the platform and make no warranties regarding the accuracy of listings.
All transactions, agreements, and communications between users are solely between those users. SafeProperty accepts no liability for disputes arising from such transactions.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must notify us immediately at support@safeproperty.co.ke if you suspect unauthorised access.
You agree to provide accurate, complete, and current information and to keep it updated. Providing false identity or property information may result in immediate account suspension.
5. Listings and Content
You represent and warrant that any property you list:
• Is a real, existing property and accurately described.
• You own, have authority to list, or are a licensed agent acting for the owner.
• Does not infringe any third-party intellectual property rights.
• Complies with all applicable Kenyan laws, including the Land Act and Landlord and Tenant Act.
We reserve the right to remove any listing at our sole discretion without notice. Duplicate listings, misleading photos, and false pricing are strictly prohibited.
6. Prohibited Conduct
You must not:
• Use the platform for money laundering, fraud, or any illegal activity.
• Scrape, harvest, or extract data from the platform by automated means without written consent.
• Reverse-engineer, decompile, or attempt to access our source code.
• Post false or misleading listings, fake reviews, or impersonate another person or entity.
• Send spam or unsolicited commercial communications to other users.
• Circumvent any security or access control measures.
7. Fees and Subscriptions
Certain features are available only on paid subscription plans. Subscription fees are listed on our pricing page and charged in Kenyan Shillings (KES) via M-Pesa or other supported payment methods. All fees are non-refundable except where required by Kenyan consumer protection law.
We reserve the right to change pricing with 30 days' notice. Continued use after price changes constitutes acceptance of the new pricing.
8. Intellectual Property
All platform content, software, trademarks, and brand assets are owned by or licensed to SafeProperty Ltd. You retain ownership of content you upload but grant us a worldwide, royalty-free licence to display, reproduce, and distribute that content on the platform and in our marketing materials.
9. Disclaimers and Limitation of Liability
The platform is provided "as is" without warranties of any kind. To the fullest extent permitted by Kenyan law, SafeProperty disclaims all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement.
Our aggregate liability for any claim arising from use of the platform shall not exceed the greater of (a) the fees paid by you in the preceding 3 months, or (b) KES 5,000. We are not liable for indirect, incidental, special, or consequential damages.
10. Dispute Resolution
Any dispute arising from these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Nairobi Centre for International Arbitration (NCIA) rules, with the seat of arbitration in Nairobi, Kenya. These Terms are governed by the laws of Kenya.
11. Termination
We may suspend or terminate your account at any time for breach of these Terms or for any other reason at our sole discretion. You may delete your account at any time via Account Settings. Termination does not affect rights or obligations accrued before the termination date.
12. Changes to Terms
We may update these Terms at any time. We will notify you of material changes by email or platform notification at least 14 days in advance. Continued use after the effective date constitutes acceptance of the updated Terms.
